Terms and Conditions of Enrolment

These Terms and Conditions govern the provision of tutoring services by Learn On Air Pty Ltd trading as Prestige Education Centre (“Prestige”, “we”, “our”, or “us”).

These Terms and Conditions may be updated from time to time and the latest version will be published on the Prestige Education Centre website.

By enrolling a student at Prestige Education Centre, the parent or legal guardian (“Parent/Guardian”) agrees to these Terms and Conditions.

1. Enrolment

1.1 Enrolment at Prestige may be completed online through the Prestige website or in person at the centre.

1.2 All enrolments are subject to approval by Prestige. Prestige reserves the right to accept or refuse enrolment at its discretion, including where the student’s level, behaviour, or other circumstances are not suitable for the program.

1.3 The agreement for tutoring services is entered into between the Parent/Guardian and Learn On Air Pty Ltd trading as Prestige Education Centre.

2. Course Structure

2.1 Prestige offers both group lessons and one-to-one tutoring sessions.

2.2 A group lesson normally consists of two 45-minute teaching sessions (90 minutes total) delivered during the same weekly class. Where advertised, group lessons may instead consist of two 60-minute teaching sessions (120 minutes total).

2.3 One-to-one tutoring sessions are 60 minutes in duration unless otherwise stated.

2.4 Group classes are conducted on a weekly basis. The average class size is approximately eight students, however class sizes may vary.

2.5 Prestige reserves the right to change tutors, class times, or class arrangements where reasonably necessary.

3. Group Class Enrolment Commitment

3.1 Students enrolling in group classes commit to a minimum enrolment period of ten (10) consecutive weeks.

3.2 Each weekly class may contain multiple teaching sessions (for example, two 45-minute lessons or two 60-minute lessons within one class).

3.3 The ten-week commitment applies regardless of the payment schedule selected.

3.4 If a student stops attending classes before completing the ten-week enrolment period, the Parent/Guardian remains liable for the remaining fees for that period.

3.5 Upon completion of a ten-week enrolment period, students will be automatically re-enrolled for the next ten-week period unless written cancellation is provided before the next lesson begins.

4. Private Classes (One-to-One or One-to-Two Lessons)

4.1 Private tutoring may be delivered either as a one-to-one lesson (one student) or a one-to-two lesson (two students).

4.2 Private tutoring may be booked either as a casual booking or as a permanent weekly booking.

4.3 Permanent bookings require attendance until the prepaid sessions have been completed.

4.4 For permanent private class bookings, upon completion of the prepaid session period, the student will be automatically re-booked for the same prepaid session duration (for example, ten weeks, five weeks, or two weeks for fortnightly bookings) unless written cancellation is provided before the last session of the prepaid period.

4.5 Where two students attend the same private class (one-to-two lesson), the same booking, attendance, and cancellation rules apply.

5. Fees and Payments

5.1 Tuition fees are published on the Prestige website and may be updated from time to time.

5.2 Payments must be made prior to attending lessons unless otherwise agreed.

5.3 Prestige accepts the following payment methods:

  • bank transfer
  • credit card
  • cash
  • direct debit
  • online payment through the Prestige website

5.4 Prestige may occasionally offer discounts or promotional pricing. Details of available discounts will be published on the Prestige website. Prestige reserves the right to introduce, modify, or withdraw any discounts or promotional offers at any time.

6. Satisfaction Guarantee

6.1 Prestige offers a 100% satisfaction guarantee for new enrolments.

6.2 If a Parent/Guardian is not satisfied after the first lesson, they may request a full refund.

6.3 The refund request must:

  • be submitted in writing via email, and
  • be made on the same day as the first lesson and before the second lesson takes place.

6.4 Where a valid request is received within this timeframe, Prestige will refund the entire payment including the first lesson.

6.5 After this period has passed, no refunds will be provided.

7. Attendance and Absences

7.1 Students are expected to attend all scheduled lessons.

7.2 Prestige does not provide make-up lessons for missed classes.

7.3 If a student is unable to attend an in-person lesson, they may join the lesson online at the same scheduled time, where available.

7.4 If a student does not attend the lesson in person and does not join online, the lesson will still be considered used.

8. Tutor Availability

8.1 If a tutor is unavailable due to illness or other circumstances, Prestige may arrange a substitute tutor or reschedule the lesson.

8.2 If Prestige cancels a lesson, the lesson will be rescheduled at a later date.

9. Online Lessons and Technology Requirements

9.1 Prestige may deliver lessons through its online learning platform where required.

9.2 Parents and students are responsible for ensuring that they have appropriate technical equipment, including stable internet access, compatible devices, and appropriate browser software.

9.3 Prestige is not responsible for technical issues arising from a student’s equipment or internet connection.

9.4 Prestige may record certain online lessons for educational purposes. However, recordings are not guaranteed for every lesson.

9.5 Access to recordings may only be available while the student remains enrolled in at least one subject.

10. Student Conduct

10.1 Students must behave respectfully towards tutors, staff, and other students.

10.2 Mobile phones must not be used during lesson time unless permitted by the tutor.

10.3 Bullying, harassment, disruptive behaviour, or misconduct will not be tolerated.

10.4 Prestige reserves the right to suspend or terminate a student’s enrolment if their behaviour is considered inappropriate.

10.5 Where enrolment is suspended or terminated due to misconduct, any outstanding fees for the enrolment period remain payable.

11. Centre Rules and Supervision

11.1 Students should arrive no earlier than five (5) minutes before their scheduled lesson.

11.2 Students must leave the centre immediately after their lesson has finished.

11.3 Prestige does not provide supervision before or after lessons.

11.4 Parents/Guardians are responsible for arranging safe arrival and departure of students.

12. Intellectual Property

12.1 All learning materials, teaching resources, recordings, teaching systems, and educational content provided by Prestige are the intellectual property of Prestige.

12.2 These materials are provided solely for the personal educational use of enrolled students.

12.3 Students and parents must not copy, record, reproduce, distribute, upload online, or share Prestige materials without written permission.

12.4 Prestige reserves the right to immediately terminate enrolment and pursue legal action where intellectual property rights are breached.

13. Student Portal Accounts

13.1 Students may be provided with access to a Prestige student portal.

13.2 Login details must not be shared with any third party.

13.3 If login credentials are shared, Prestige may suspend access or terminate enrolment.

14. Tutor Non-Solicitation and Contact Restrictions

14.1 Parents and students must not contact Prestige tutors privately for tutoring services outside Prestige.

14.2 Parents and students must not attempt to hire, engage, or arrange tutoring services directly with any Prestige tutor outside Prestige.

14.3 Parents and students must not encourage, induce, or attempt to persuade any Prestige tutor to leave Prestige or provide tutoring services independently.

14.4 Written permission must be obtained from Prestige before any such engagement.

14.5 This restriction applies during the student’s enrolment at Prestige and for 24 months after the student’s enrolment ends.

15. Parent Communication with Tutors

15.1 Parents must communicate with tutors only through official Prestige channels.

15.2 Direct private communication with tutors via personal phone numbers, social media, or messaging applications is not permitted unless authorised by Prestige.

16. Photography and Marketing

16.1 Prestige may take photographs or videos of classes and activities for marketing and promotional purposes.

16.2 By enrolling at Prestige, the Parent/Guardian consents to such use unless they notify Prestige in writing requesting otherwise.

17. Property Damage

17.1 Parents/Guardians are responsible for any damage caused by a student to Prestige property, equipment, or facilities.

17.2 The Parent/Guardian may be required to cover reasonable repair or replacement costs.

18. Academic Outcomes

18.1 Prestige provides tutoring support designed to assist students in their learning.

18.2 Prestige does not guarantee specific academic results, examination outcomes, or school performance.

19. Force Majeure

19.1 Prestige may move lessons online or reschedule lessons in circumstances outside its reasonable control including government restrictions, lockdowns, building issues, tutor illness, or emergencies.

20. Privacy

20.1 Prestige may collect personal information relating to students and parents including contact information, academic results, school reports, and emergency contact information.

20.2 This information is used for educational administration and communication purposes.

21. Liability

21.1 Prestige will provide tutoring services with reasonable care and skill.

21.2 To the extent permitted by law, Prestige is not liable for indirect loss, academic outcomes, or damages arising from participation in tutoring services.

22. Recovery of Outstanding Fees

22.1 If fees remain unpaid, Prestige reserves the right to suspend enrolment until payment is made.

22.2 The Parent/Guardian remains responsible for payment of all outstanding fees owed under this agreement.

23. Late Payments and Overdue Fees

23.1 Tuition fees must be paid by the due date specified by Prestige.

23.2 If payment is not received by the due date, Prestige reserves the right to suspend enrolment, deny attendance to classes, or restrict access to the student portal or online platform.

23.3 Prestige may charge reasonable administrative costs associated with recovering overdue payments where permitted by law.

23.4 The Parent/Guardian remains responsible for all unpaid fees relating to the student’s enrolment period.

24. Governing Law

24.1 These Terms and Conditions are governed by the laws of the State of Victoria, Australia.
